What is an Executor
An Executor is a person appointed by the testator in the Will to administer the estate after the testator’s death, including fulfilling the testator’s wishes and instructions.

You may appoint either an individual or an organization such as a trust company. The testator is free to appoint anyone as the Executor, whether from among the heirs or trusted friends.

Note: It is highly recommended to appoint the wife as the Property Custodian for the children.

The father is the primary and rightful custodian of both the person and the property of his underage children. When the father passes away, the legal right of guardianship over the child is transferred to the paternal grandfather (the father of the husband, i.e., the wife’s father-in-law). If the grandfather has also passed away, the guardianship right will then transfer to the executor (wasi) appointed by the father.

If the father did not leave a will at the time of his death and his father (the child’s grandfather) has also passed away, the wife does not have the legal right under Islamic law to manage her underage child’s property. In such a case, the inheritance received by the child will be handed over to Amanah Raya to be managed until the child reaches adulthood.

Note: It is best to request your husband to prepare a will and appoint you as the Property Custodian.
